New York City rent increase calculator

Order 57 allowed 3% on one-year and 4.5% on two-year renewals for leases starting from October 2025. Order 58, covering leases from 1 October 2026, is a rent freeze: 0% on both.

How the New York City cap works
The increase applies to renewal leases, which the landlord must offer 90 to 150 days before the current lease ends. Market-rate apartments are not covered and have no cap, though since 2019 landlords must give 30 to 90 days’ notice of increases of 5% or more.
Exemptions
- Applies only to rent-stabilized apartments (roughly one million units, mostly in buildings of six or more units built before 1974). Market-rate apartments have no cap.
- Rent-controlled apartments follow a separate Maximum Base Rent system.
Renewal lease offered 90 to 150 days before the current lease ends; the RGB increase applies to the renewal.

- Late fees: Lesser of $50 or 5% of monthly rent; no late fee unless rent is unpaid more than 5 days after the due date; lease clauses waiving this are void. Application/background-check fee capped at $20 or actual cost.
- Security deposit: 1 month's rent; returned 14 days after the tenant vacates, with an itemized statement of any deductions; failure to provide both within 14 days forfeits the right to retain any part of the deposit.
